Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Creatorly website, mobile applications, APIs, and related services (collectively, the “Service”) operated by Creatorly (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and capable of entering a binding contract. Creators and brands must provide accurate registration information and comply with applicable laws in India, including tax and KYC requirements for payouts.
2. The Service
Creatorly provides a marketplace-style platform for brands to publish campaigns and contests, for creators to apply and submit content (including Instagram post URLs), and for payments and payouts to be processed through third-party payment partners. We facilitate transactions between brands and creators; we are not a bank, prepaid payment instrument, or e-wallet provider. We do not guarantee campaign outcomes, follower growth, or specific earnings.
3. Accounts
- You are responsible for safeguarding your login credentials.
- You must notify us promptly of unauthorized access to your account.
- We may suspend or terminate accounts that violate these Terms or applicable law.
4. Brand obligations
- Provide accurate campaign briefs, budgets, and deliverables.
- Fund campaigns through approved payment methods before expecting creator work.
- Review submissions in good faith and within reasonable timeframes.
- Comply with advertising disclosure rules (including #ad or platform-specific labels where required).
5. Creator obligations
- Submit original content or content you have rights to use.
- Follow campaign rules, including hashtags, mentions, and posting windows.
- Connect only social accounts you own or are authorized to use.
- Complete KYC and provide valid payout details before requesting withdrawals.
6. Payments, fees, and payouts
Payments for campaign funding, contest prize pools, and creator payouts are processed by licensed third-party providers (including Razorpay). By using payment features, you also agree to their terms and policies. We may charge platform or processing fees as disclosed in the app or at checkout. Creator earnings and contest prizes are subject to verification, KYC approval, funded balance availability, holds, and partner processing times. For contests, prize distribution follows the rules set by the brand and may require winner selection after the contest period ends. We are not responsible for delays caused by banks, UPI networks, payment partners, or incorrect payout details you provide.
7. Content and intellectual property
Creators retain ownership of their content unless otherwise agreed in writing with a brand. By submitting content through the Service, you grant Creatorly and the relevant brand a license to use, display, and review that content for campaign administration, verification, and reporting. Brands must not use creator content beyond agreed campaign scope without separate permission.
8. Prohibited conduct
You may not:
- Use the Service for fraud, spam, or illegal activity;
- Circumvent verification, payment, or payout controls;
- Impersonate others or misrepresent follower metrics;
- Upload malware or attempt to disrupt the Service;
- Reverse engineer the Service except where law permits.
9. Objectionable content and abusive behaviour
There is no tolerance for objectionable content or abusive users on Creatorly. By using the Service you agree not to submit, post, or share content that is sexually explicit, violent, hateful, harassing, defamatory, discriminatory, or otherwise objectionable, and not to harass, threaten, impersonate, or abuse any other person using the Service.
Where user content appears in the Service, including the in-app feed:
- You can report it. Every post carries a report control, and creator profiles can be reported the same way. Reports can also be sent to support@getcreatorly.com.
- You can block the person who posted it. Blocking takes effect immediately, needs no review, and is managed in Settings → Blocked accounts.
- We act on reports within 24 hours. We review every report and remove content that breaches this section.
- We remove offending users. Accounts that post objectionable content or behave abusively may be suspended or terminated, and any funds owed are handled under section 6.
We may remove or hide content at our discretion where it breaches these Terms. Removal of content does not by itself cancel a payment already earned for delivered work; disputed payments are handled under section 6.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATORLY AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) INR 5,000.
12. Indemnity
You agree to indemnify and hold harmless Creatorly from claims arising from your content, your breach of these Terms, or your violation of third-party rights.
13. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach, risk, or legal requirements. Provisions that by nature should survive termination will survive.
14. Governing law
These Terms are governed by the laws of India. Courts in India shall have exclusive jurisdiction, subject to mandatory consumer protections where applicable.
15. Changes
We may modify these Terms by posting an updated version on this page. Material changes may be notified through the Service or email where appropriate.
